Victoria Cha – Principal

I specialise in commercial litigation and insolvency law.

I was called to the New South Wales Bar in 2014 and practised law as a barrister until 2020. Since mid-2020, I have practised commercial litigation and dispute resolution as a solicitor for one of the leading boutique firms based in Sydney.

I have extensive experience in conducting commercial litigation. I regularly conduct and appear in complex commercial proceedings before the Federal Court of Australia, State Supreme Courts and Court of Appeal, and other courts and tribunals.

Intelli Law is a new firm and I have appeared in and advised on a wide range of matters including in the following areas:

  • General commercial disputes, particularly equity, trusts, property and contractual dispute matters. For example, disputes relating to commercial lease, contract for sale of land, joint ventures, ACL matters including misleading and deceptive conduct, misrepresentation or unconscionable conduct, injunctive relief, partnership/employment disputes, shareholders dispute, insurance matters and building and construction litigation.

  • Corporations law and insolvency, matters arising under the Corporations Act 2001 (Cth) including breach of director’s duties, winding up application, voluntary administration or receivership, statutory demands and bankruptcy.
  • Intellectual property, including patent and trade mark opposition proceedings, confidential information, designs, passing-off, trade names and misleading advertising. Victoria has participated in many court-annexed and private mediation, conciliation conferences and arbitration and has acted for both plaintiff and defendant. She is proactive in using alternative dispute resolution processes as a flexible and cost-effective alternative to the judicial determination of disputes.

  • Advised and appeared for many clients involving corporations law including directors’ duties, business judgement rule and shareholder dispute.
  • Advised corporate clients on deeds of company arrangement, administration and receivership, oppression, winding up.
  • Advised and appeared for many clients involving general commercial disputes including contract claims, construction, commercial lease, summary judgment, misleading or deceptive, misrepresentation, unconscionable conduct, equitable claims, fiduciary relations, estoppel, implied and constructive trusts.
  • Advised the clients in property and conveyancing matters including mortgagee exercise of the power of sale, indefeasibility of title, caveats and priorities.
  • Advised and appeared for clients in family law proceedings on property settlement, superannuation, property interest by a third party.
  • Successfully appeared for the Korean government agency concerning security for costs in the context of foreign judgment registration.
  • Successfully represented in contract for sale of land, breach of contracts and misleading or deceptive conduct.
  • Successfully represented the plaintiff in an appeal concerning the construction of a contract and whether a term of the contract was a penalty.
  • Represented the respondents in hearing concerning the quantification of equitable compensation for over $200 million.
  • Successfully represented the respondents concerning the exercise of the option agreement, breach of contract and unconscionable conduct within the meaning of s 21 of the Australian Consumer Law.
  • Represented the defendant in application for interlocutory injunction concerning a notice of termination of the employment contract and confidential information.
  • Successfully represented the respondents in application for leave to bring derivative proceedings.
  • Successfully represented the defendant in an appeal concerning the claim for debt and unjust enrichment.
